End User License Agreement

1. Agreement

By downloading, installing, or using RidgeSense ("the App"), you agree to be bound by this End User License Agreement ("Agreement"). If you do not agree, do not use the App.

2. License Grant

Topo Intel LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, subject to this Agreement and the Apple App Store Terms of Service.

3. The App Is Not a Medical Device

RidgeSense provides estimates based on published physiological models and user-provided data. It is not a medical device, not FDA-approved, and not a substitute for professional medical advice. Calorie targets, readiness scores, hydration estimates, and biometric calculations are approximations. Consult a physician before undertaking any endurance activity.

Core temperature estimates use a Kalman filter model (non-invasive proxy) and should not be used for clinical decision-making. SpO2 readings from consumer wearables have lower accuracy than medical-grade pulse oximeters. Heart rate variability metrics reflect autonomic trends, not diagnostic values.

4. Assumption of Risk

Thru-hiking, backpacking, and endurance athletics involve inherent risks including but not limited to: altitude illness, dehydration, hypothermia, hyperthermia, wildlife encounters, falls, lightning, flash floods, and equipment failure. RidgeSense is a planning and monitoring tool. It does not eliminate risk.

Weather window assessments are based on historical data and may not reflect current conditions. Pass risk levels (open, risk-shoulder, closed) are estimates. Always verify conditions with local ranger districts and NOAA forecasts before entering high-altitude terrain.

The emergency portal and alarm escalation system depend on device connectivity and battery. They may not function in all conditions. Carry a dedicated satellite communicator (Garmin inReach, SPOT, etc.) as a redundant emergency communication device.

5. Emergency Portal

The emergency contact portal is provided free of charge on all subscription tiers. Portal availability depends on server uptime and internet connectivity of the person accessing the portal. Topo Intel LLC does not guarantee 100% uptime.

The portal displays data provided by the user. Topo Intel LLC is not responsible for the accuracy of user-entered emergency contact information, medical notes, or trip itineraries.

SAR pre-authorization is a user-declared preference. It does not create a contractual obligation between the user and any search-and-rescue organization. Actual SAR activation depends on the responding agency's protocols.

6. Subscription and Payment

Subscription pricing is available in the App Store. Topo Intel LLC reserves the right to modify pricing with 30 days notice.

Subscriptions are billed through the Apple App Store. Topo Intel LLC does not process payment information directly. Refer to Apple's terms for billing disputes, refund policies, and subscription management.

7. Intellectual Property

RidgeSense, the contour line motif, and the Topo Intel brand are trademarks of Topo Intel LLC. The engine architecture, algorithms, and user interface design are proprietary. Trail data (resupply points, weather windows, community reports) is sourced from public agencies and community contributors.

8. Data and Privacy

See the Privacy Policy for details on data collection, storage, and your rights under CCPA. Summary: your health data stays on-device unless you explicitly share it. We do not sell personal information. The emergency portal access log records IP addresses of viewers for your awareness.

9. Limitation of Liability

To the maximum extent permitted by law, Topo Intel LLC is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes but is not limited to damages from reliance on calorie estimates, weather assessments, readiness scores, or emergency portal functionality.

Topo Intel LLC's total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Termination

This Agreement terminates when you delete the App or when Topo Intel LLC terminates your account. Sections 3, 4, 9, and 12 survive termination.

11. Governing Law

This Agreement is governed by the laws of the State of Texas, without regard to conflict of law provisions.
